LEGAL
Terms of Use
These Terms of Use ("Terms") govern your use of the Airwave application for Android TV and Android phones, the website and the account services that come with them (together, "Airwave"). Airwave is provided by RHYTHM Technologies("we", "us", "our"). By creating an account, installing or using Airwave you agree to these Terms. If you do not agree, do not use Airwave.
1. Airwave is a media player only
Airwave is a media player only and does not provide any content. Airwave is not affiliated with any content provider and does not endorse the use of illegal content sources. To watch anything, you must add your own playlists. Any paid subscription or premium upgrade unlocks application features only; it does not include, or provide access to, any channels, streams, or media content.
Channels, programme guides, movies, series, videos, logos, posters and descriptions shown in Airwave come from the playlists, folders, shares and services you add. We do not host, supply, sell, check or control them, and we are not responsible for them.
2. Your playlists and your responsibility
- You may only add playlists and sources that you are legally entitled to use, and you are solely responsible for them and for how you use them.
- Web folders and network shares. Airwave can play videos from a web folder (a web page that lists files) or a network share (SMB) that you add. You may only add folders and shares that you own, or whose owner has given you permission to access and play their contents, and only videos you have the right to watch. Airwave reads the folder you add and the folders inside it on your device; we do not host, copy, index or check those files.
- You must follow the laws that apply to you and the terms of the services whose playlists you add, including any limits they set on simultaneous connections or devices.
- Your devices connect directly to the sources you add. Those sources, not we, decide what they offer and whether it works.
- We may remove a playlist from our account services, or suspend an account, if we are told or reasonably believe that it is being used to infringe the rights of others or to break the law.
3. Your account
- You need an account to use Airwave. Give a valid email address and keep it verified, and keep your password secret. You are responsible for activity on your account.
- Your plan sets how many devices and playlists your account can use. You can see and remove your devices and playlists on your account page.
- An account is for one person and the devices in their household. Do not share, sell or transfer your account.
- You must be at least 13 years old to create an account, or older where the law where you live requires it. If you are under 18, you need the permission of a parent or guardian.
4. Trial, Free and Premium plans
- We may offer a free trial, a free plan and a Premium plan. What each includes (for example which sections play, and how many devices and playlists) is shown on our website and in the app.
- The plan terms shown when you create your account apply to your account. If we change plan terms later, the change applies to new accounts and does not reduce what your account already has, unless you agree to it or the law requires it.
- Premium unlocks application features only. It does not include any channels, streams or other content.
- Where Premium is paid for, the price, billing and any refund terms are confirmed to you before you pay. Nothing in these Terms limits any refund or other right you have under consumer protection law.
- Premium bought in the app from Google Play is a subscription billed by Google and covered by Google Play's terms. It renews until you cancel it in Google Play, and applies to your Airwave account on all your devices while it is active.
5. Acceptable use
You agree not to:
- copy, modify, decompile, reverse engineer or redistribute Airwave, except where the law expressly allows it;
- get around the limits of your plan, or access Airwave or its services by automated means;
- interfere with, overload or try to gain unauthorised access to Airwave, its servers or other users' accounts;
- use Airwave to break the law or to infringe anyone's rights;
- remove or change any notices of ownership in Airwave.
6. Updates
We may update Airwave to fix problems, improve it or keep it secure. Some updates are required: until a required update is installed, the app may not work. We may change or stop features at any time.
7. Ownership
Airwave, its software, design, name and logo belong to RHYTHM Technologies or its licensors. These Terms give you a personal, limited, non-exclusive, non-transferable licence to use Airwave on your own devices for as long as you follow these Terms. Content shown in Airwave belongs to its respective owners.
8. Disclaimer
Airwave is provided "as is" and "as available". To the extent the law allows, we make no promises that Airwave will be uninterrupted, error-free or compatible with every device or source, and we disclaim all implied warranties, including fitness for a particular purpose and non-infringement.
9. Limitation of liability
To the extent the law allows, RHYTHM Technologies is not liable for indirect, incidental, special or consequential loss, or for loss of data, profits or content, arising from your use of Airwave or of any source you add. Our total liability for any claim about Airwave is limited to the amount you paid us for Airwave in the twelve months before the claim. Nothing in these Terms limits liability that cannot be limited by law.
10. Indemnity
You agree to compensate RHYTHM Technologies for claims, losses and costs (including reasonable legal fees) that arise from the playlists and sources you add, from your breach of these Terms, or from your breach of the law or of anyone's rights.
11. Suspension and ending your account
You can stop using Airwave at any time and delete your account yourself: in the app under Account, or on your account page on our website (see how to delete your account). You can also write to registration@airwavetv.live. Deleting your account does not cancel a Google Play subscription; cancel it in Google Play. We may suspend or close an account that breaks these Terms, or where the law requires it. Sections 1, 2, 7, 8, 9, 10 and 13 continue to apply after your account ends.
12. Changes to these Terms
We may change these Terms. We will post the new version on this page with a new effective date and, for significant changes, tell you by email or in the app. If you keep using Airwave after the change takes effect, you accept the new Terms.
13. Governing law and disputes
These Terms are governed by the laws of India. Disputes arising from them or from Airwave are subject to the jurisdiction of the courts of India. This does not take away any protection you have under the mandatory consumer laws of the country where you live.
